Tamil Nadu Apartment Ownership Act: New Rules in Effect 

Tamil Nadu Apartment Ownership Act, new rules came into effect, with the establishment of regulations on September 24. 

The Housing and Urban Development Department has provided a framework for renovating 30-year-old buildings. 

And, have been blocked owing to opposition from a few occupants. This strengthened the Tamil Nādu Apartment Ownership Act which came into effect on March 6th. 

Tamil Nadu Apartment Ownership Act: New Rules 

At least four apartment owners are needed to create an organization, which must then be created using e-laws and registered according to the requirements. 

When there is more than one tower on a property, the organizations can join apartment owners to establish a federation, with the president and treasurer of each tower acting as members of the board of management. 

According to a Housing & Urban Official: 

“To rebuild, the resolution is a must. The board of managers must call a special general meeting, either on their own or at the request of one-fourth of the apartment owners.  

The resolution passed says that the association must tell the chief planner, the plan unit of the Chennai Metropolitan Development Authority, or the local planning authority about the decision to redevelop the project. 

This must be done with the written permission of at least two-thirds of the apartment owners.”  

Tamil Nadu Apartment Ownership Act entails the owners to be informed: 

Within ten days of making the choice, the group has to send written notices to all apartment owners. 

Flat owners can be unhappy with the way permission for redevelopment was gained. 

Within 30 days, he or she can object with the right body under the Tamil Nadu Apartment Ownership Act. 

If the authority is unhappy with how permission for redevelopment was gained, it will tell the group what it needs to do. 

If the right steps were taken by the apartment owners group, the complaint against the move would be turned down.  

The Attributes required in the Report: Tamil Nadu Apartment Ownership Act 

The report needs to include information about the carpet area, other places to live or rent payments, security deposits, empty spaces, gardens, parking, building specifications, common areas, recreation facilities, and other amenities that will be given to apartment owners, as well as the time limit for finishing the redevelopment project and any other important details.  

Owners Consent on Redevelopment Plans: 

According to the new rules in the Tamil Nadu Apartment Ownership Act, The association must get written permission from at least two-thirds of the apartment owners, make a deal with the marketer, and send the rebuilding plan to the authority within 30 days of the deal being signed.  

“This is helpful to learn how to run an association,” said S. Ramprabhu, head of the CMDA and DTCP committees for the Builders Association of India (BAI). The whole state has to deal with redevelopment, and these rules make it clear how to go about it. The government has to set up a way for people to send applications online.
