How to Enter Your Name on the Property Tax Record

Buying a home is often a long drawn out process. But it becomes a nightmare if your paperwork is not in place. So, you bought a new home? You have all the papers- the Sale Agreement, Sale Deed, Khata Certificate, and a whole lot of other documents? Good job, we say! But what about changing the name in the property tax record? The significance of getting a property transferred under the new owner’s name or the builder is often overlooked.

So, what are the implications of this? From the legal aspect, if the municipal corporation document is still registered in the old property owner’s name, then the tax records and receipts would be generated in the name of the former owner, and he or she will be legally responsible for paying the bills.

It might sound like a good thing for a buyer to be absolved of future taxes! But in reality, if taxes are not paid, then the associated utilities might be disputed, which will harm the new owner a lot more in the long run.

Understanding the process

Some of the documentation involved in real estate has changed over the years. It’s not really as cumbersome a process as you envisage. Well, getting the name changed on the property tax records is quite simple. It becomes even smoother if you have all the required documents in place.

Step 1: The documentation

For the change in name process, the copy of the following documents will be essential:

  • Receipt of tax last paid
  • Attested copy of the sale transaction deed
  • No Objection Certificate from the associated housing society
  • Duly-filled application form with signatures

Step 2: Submit these documents to the Commissioner of Revenue.

Step 3: Wait. After the application is submitted, the verification process takes about 15 to 30 days for the approval and change of name on the official tax records.

Mutation of property

You can also transfer the property to the buyer’s name through mutation of property.

Mutation procedure is carried out in the department of land revenue. It helps the property owner to transfer the title ownership after the property is purchased or inherited.

Mutation procedure includes giving an application along with the non-judicial stamp. The application must have information regarding the property and should be submitted to the area Tehsildar.

While the procedure and necessary documentation may vary from state to state, a No Objection Certificate (NOC) is mandatory. In case of the inherited property (in the case of the earlier property owner’s death), an affidavit of the original death certificate will be necessary.

Submit the adequately filled mutation form with the required documentation for changing the title ownership. Mutation of the property allows the municipal authority to alter the property tax record with the present property owner name and issue correct tax documents.

  1. I liked what you said about how the property owner can transfer the ownership better trough the mutation procedure by the land revenue department. My mom has been thinking of transferring her home to her oldest child so that she will be able to keep the family plot of land. Getting some help to transfer the property could be really useful and allow them to be a lot safer and done better.

  3. My father expired recently. The house is in his name. Now if I dont want to transfer it as of now to my mother’s name, can I still fill the house tax. If yes how & if I change the name to my mother’s name what is the procedure, charges & time taken for transfer to be complete.
