Obtaining an occupancy certificate

We had booked a flat in May 2012 and the builder had informed us that it would be ready for possession from Jan 2015. It has not been handed over yet, and the builder says he hasn’t received the occupancy certificate from the authorities. How much time does it take to issue the certificate?

The occupancy certificate has to be issued by the sanctioning authority after the completion of the building as per the approved plans. If the certificate is not being issued due to some major or minor violations in the building, the building has to be restored to the condition as has been approved by the authorities.

If it is merely a procedural delay, an active follow-up from the builder is required to obtain the same.

You can file an application under RTI to ascertain the status of issuance of the said certificate.
